Version 2026-1-entwurf

Open points

These points have to be resolved before publication.

  1. Seat and legal form: Until the seat and legal form of [FIRMA] are fixed, it is unclear whether section 5 ECG and section 25 MedienG (Austria), section 5 DDG (Germany) or both apply. When offering to users in several countries, the requirements of each legal system must be checked.
  2. Norm references: docs/legal contains no sources on imprint and disclosure duties. All cited norms (section 5 ECG, section 25 MedienG, section 5 DDG) are listed only as "to be checked"; mandatory details, scope and current wording must be confirmed by a lawyer.
  3. Disclosure under section 25 MedienG: Whether the website is a "medium" under the Austrian Media Act and which details (media owner, business purpose, basic direction) must be disclosed needs clarification.
  4. Supervisory authority and chamber: Whether the activity is subject to trade or professional supervision is open.
  5. Telephone number: Whether a phone number is mandatory or a second fast contact option (e-mail, contact form) suffices must be checked per jurisdiction.
  6. Consumer dispute resolution: The service targets businesses only; whether a notice or participation duty exists must be checked.
  7. Switzerland: For providers with seat or target audience in Switzerland, the imprint duty (e.g. under unfair competition law) is not substantiated in docs/legal and must be checked.
  8. Responsible for content: Whether and for which content a named responsible person must be given is open.
